TO WHOM IT MAY CONCERN:  The application described below has been submitted for an Aquatic Resource Alteration Permit under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108.  In addition, federal permits may be required from the U. S. Army Corps of Engineers and the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act, RESPECTIVELY.  Section 401 of the Clean Water Act requires that an applicant obtain a water quality certification from the state when a federal permit is required.  This notice may cover applications subject to §401.

No decision has been made whether to issue or deny this permit.  The purpose of this notice is to inform interested parties of this permit application and to ask for comments and information necessary to determine possible impacts to water quality.  Persons wishing to comment on the proposal are invited to submit written comments to the department.  Written comments must be received within thirty days of the date that this notice is posted.  Comments will become part of the record and will be considered in the final decision.  The applicant’s name and permit number should be referenced.

PROJECT DESCRIPTION:  The applicant proposes to dredge at the Willow Point Marina on Little River in the Fort Loudoun reservoir with sediment disposal at an offsite, upland location.  The affected area constitutes Exceptional Tennessee Waters (ETW).  The dredging is proposed to occur in three phases.  Phase A will remove sediment from a current depth of 2 feet to a depth of 8 feet below summer pool elevation and remove approximately 15,000 cubic yards of sediment.  Phase B will remove sediment from a current depth of 6 feet to 10 feet below summer pool elevation removing approximately 5,700 cubic yards of sediment.  Phase C will remove sediment from a current depth of 2 feet to an approximate depth of 6 feet below summer pool elevation retmoving approximately 23,000 cubic yards of sediment.  The purpose of the proposed work is to increase the depth of the marina to allow access throughout the year.  The proposed dredging activities will involve a floating dredging unit which will pump the dredged material to a secondary pump on shore which will transfer material to two filter bags.  The proposed dewatering activities will use woven geotextile filtration bags with a water flow rate of 20 gpm/ft².

Little River-Fort Loudoun Reservoir (TN06010201026_1000) is in the Southern Limestone/Dolomite Valleys and Low Rolling Hills (67f) ecoregion.

Little River was assess in February 2015.  It is not supporting its designated use of recreation caused by Polychlorinated biphenyls.  The source is listed as contaminated sediments.  Other designated uses are fully supporting.

ANTIDEGRADATION

In accordance with the Tennessee Antidegradation Statement (Rule 0400-40-03-.06), the Department has made a preliminary determination that the proposed activities will result in greater than de minimis degradation of ETWs.  Pursuant to Antidegradation Statement, in waters identified as ETWs, an activity that would cause degradation of habitat above the level of de minimis will only be authorized if the applicant demonstrates to the Department that reasonable alternatives to degradation are not feasible, the degradation is necessary to accommodate important economic or social development in the area, and the activity will not violate water quality criteria for uses existing in the receiving waters.  Accordingly, the applicant has submitted an alternatives analysis and social and economic justification and the Department is seeking public comment on these subjects.

PROCEDURE FOR MAKING A FINAL DETERMINATION:  Following the close of the public comment period, the Department will consider all comments of record and the requirements of applicable federal and state laws and make a final determination of whether the proposal will result in degradation above the level of de minimis in an ETW.  If the Department determines that the proposed habitat alteration  would result in degradation of an ETW above the level of de minimis, it will also make a final determination of whether that degradation is, or is not, necessary to accommodate important economic or social development in the area and will provide notice of this determination.  In making the decision of whether to issue or deny the ARAP, a determination will be made regarding the lost value of the resource compared to the value of any proposed mitigation.  The Department shall consider practicable alternatives to the alteration and to the proposed degradation.  The Department shall also consider loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource and adverse impact to unique, high quality, or impaired waters.

APPEAL:  After the Department makes a final permit decision, a permit appeal may be filed by the application or by any aggrieved person who participated in the public comment period whose appeal is based on comments given to the Department in writing during the public comment period or in testimony at a formal public hearing.
