WHEREAS default has occurred in the payment of a debt due Barbara Jean Shagan, secured by a Deed of Trust dated 2/11/11 from Kathleen R. Thompson, and recorded at Instrument # 201102170049923 in the Register’s Office for Knox County, Tennessee; and whereas A. Scott McCulley has been appointed as Substitute Trustee by Instrument dated 11/29/23 and recorded at Instrument # 202312080029033 in the Register’s Office for Knox County, Tennessee; and whereas A. Scott McCulley, Substitute Trustee has been requested to sell the property securing the debt, the following said property will be sold at the front door of the City County Building, 400 Main Street, Knoxville, Tennessee on 1/10/24 at 1 p.m.
SITUATED in District No. One (formerly Two) of Knox County, Tennessee, within the 13th Ward of the City of Knoxville, Tennessee, and being known and designated as part of Lots 1 and 2 of J. C. White’s First Addition to the City of Knoxville, Tennessee, being more fully described as follows:
BEGINNING at an iron pin in the southern line of McCalla Avenue, which said iron pin is distant 13.1 feet in a westerly direction from the point of intersection of the southern line of McCalla Avenue with the western line of Fern Street if these line be extended; thence along the southern line of McCalla Avenue South 41 deg. 10 min. West, 63.20 feet to an iron pin in said line of McCalla Avenue; thence South 37 deg. 59 min. East, 99.15 feet to an iron pin in the line of a fence; thence along said fence line North 45 deg. 57 min. East, 24.9 feet to a point at the steps to a porch of a dwelling house; thence North 38 deg. 16 min. West, 42 feet to an iron pin; thence North 41 deg. 45 min East, 57.3 feet to an iron pin in the western line of Fern Street; thence with said line of Fern Street, North 43 deg. 50 min. West, 58.97 feet to a point designated by a cut in said line of said Street; thence on a curve to the left in a northwesterly direction a distance of 19.9 feet to an iron pin in the southern line of McCalla Avenue, the place of BEGINNING, as shown by survey of W.S. Lack, Engineer, Knoxville, Tennessee, dated 20 November 1959.
Being the same property conveyed to Kathleen R. Thompson from Barbara Jean Shagan by Deed dated 2/8/11 and recorded at Instrument # 201102170049922 in the Register’s Office for Knox County, Tennessee.
This conveyance is made subject to all applicable easements, restrictions and building setback lines of record in Knox County, Tennessee.
The Property, known as 3822 Martin Luther King, Jr., Avenue, Map & Parcel: 82DL/4, will be sold for cash in bar of right and equity of redemption and dower rights. The property is sold subject to applicable easements, restrictions, covenants, prior encumbrances and unpaid taxes.
The sale held pursuant to this Notice may be rescinded at the Substitute Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time and place certain, without further publication, upon announcement at the time and place for the sale set forth above.
