Rogue Liberal Judges
The genius of the American constitution and government is readily apparent to anyone who has studied the history of other countries. The independence of the three distinct branches of the government, the executive, the judicial and the legislative, is absolutely essential to democracy and the continuation of our republic. Presidents throughout our history have tested the limits of presidential power; Abraham Lincoln, Theodore Roosevelt, Woodrow Wilson, Franklin Roosevelt, Richard Nixon, Barack Obama, Joe Biden and Donald Trump all tested those limits. Yet one of the most important aspects of the ingenious system of checks and balances in our government structure is that none of the three branches tries to dominate the other two.
Donald Trump has been President of the United States since January 20, 2025, and the court injunctions have continued to flow like a raging river. Perhaps the most notable injunction last week was granted by a federal district judge regarding the deportation of Venezuelan gang members. There were 15 injunctions during the month of February alone, which is more than there were during all of the first three years of Joe Biden’s presidency. Not coincidentally, the great majority of the injunctions have been by judges nominated by Democrats. It is part of a coordinated effort by blue states, progressive organizations masquerading as nonprofits and other entities brought against the second Trump administration. The strategy involves filing the suit before a sympathetic judge or what some in the legal community refer to as “forum shopping.”
Ben Weingarten states in a terrific article that, according to the Harvard Law Review, “courts slapped the first Trump administration with 64 universal injunctions, more than half of all such injunctions entered between 1963 and 2023 – – – that is, over six decades. Democrat-nominated judges issued 92% of these orders.”
Judges appointed by Republican administrations have shown far more restraint in issuing injunctions to micromanage the president’s executive functions. Joe Biden bragged about having defied the U.S. Supreme Court in his effort to forgive more student debt after the high court had ruled he could not do it. Of course, Biden didn’t really cancel anything, he merely shifted the debt from those who accrued it to the taxpayers generally through higher taxes and bigger interest payments on the national debt. The same folks who are squalling now, wringing their hands and crying we are in the middle of a constitutional crisis, are the same people who tried to curtail or kill free speech, warned that our democracy was in danger from opinions that varied from their own, and the world was ending within a few short years because of climate change.
The idea of a district judge anywhere in the country interfering with foreign policy, or any other function of the presidency is relatively new and started in earnest in 2017. Yep, right after Donald Trump was inaugurated for the first time. There is only one commander-in-chief and it’s not a district judge anywhere. Imagine for a moment, terrorists land on American shores and the president directs the Army to meet them and a federal district judge issues an injunction saying the chief executive cannot send the military.
The three distinct branches of our federal government all have very different functions. The president cannot amend a bill before Congress or personally sponsor legislation. The Congress may not direct the military. The judiciary cannot pass laws. The fact that the judiciary has been revered for so long in this nation is because it has largely remained above and out of politics. George W. Bush did not attempt to dismantle the bureaucracy or cull out those federal bureaucrats who opposed his policies. The “resistance” being employed by the federal government is contrary to what voters expressed in voting for Trump. Those federal employees who consider themselves as part of the “resistance” can do so from the private sector.
Remember, it was the Left who called for packing the Supreme Court when they did not get their way, but they now hail every Leftist federal judge harassing the Trump administration where the law has not been violated or impinged upon.
Trump Keeps Campaign Promise, Eliminates Department Of Education
President Trump is winding down the Department of Education. Jimmy Carter promised Iowa teachers he would create a national department and won the Iowa caucuses and kept his word. Ever since and $3 trillion later, our cumulative test scores are worse than ever. That is even more alarming when one considers we haven’t been raising standards, but lowering them instead. Gifted classes were extinguished in many school systems because of the woke ideology which resented the idea not every student was equally good in every subject. Even so, we couldn’t possibly remind some others and their parents that some students excelled in certain subjects and areas. The educational equivalent of a participation trophy has become a high school degree. One 18-year-old girl is suing her high school after she graduated with honors and says she cannot read. That is true of a young man in Clarksville, Tennessee, who said he graduated with an outstanding GPA and cannot read.
Only the educational-industrial complex bureaucrats could possibly think it was better for the schools and their personnel to have all the say in the education of a child and ignore parents. Unfortunately, it is true not every child has a great parent/parents, but the educational complex doesn’t love somebody else’s child; they love making all the choices and decisions because they know more than everybody else. At least they think they do.
The proof of the pudding is in the tasting and after pouring $3 trillion into the Department of Education what have we gotten for our investment? The lowest scores and ratings in reading, writing and math we’ve ever had. The teachers’ unions have told us for years that if we would only invest more and more money, we’d see more positive results. We have invested more and we’ve not seen good results. Quite the contrary. Parents love their children and want the best for them. Parents and kids deserve choices and the decision by President Trump to send the money back to the states is a wonderful one that really will improve education and the lives of our children and their children.
