TRUSTEE’S NOTICE OF FORECLOSURE
WHEREAS, BRANDON LEE GIBSON and JOCELYN GIBSON executed a Promissory Note payable to HAZEL DEVELOPMENT, LLC, a Tennessee limited liability company, dated November 30, 2015, in the original principal amount of One Million One Hundred Thousand and No/100 Dollars ($1,100,000.00) (the “Note”), which Note is more fully described in and secured by a Commercial Deed of Trust, Assignment of Rents and Lease, and Financing Statement executed by BRANDON LEE GIBSON and JOCELYN GIBSON, dated November 30, 2015 and recorded as Instrument Number 2015120010033342 in the Register’s Office for Knox County, Tennessee, to which reference is here made, and the undersigned, STEFFANIE M. SPECK, ESQ., having been appointed Trustee (the “Deed of Trust”);
WHEREAS, default in the payment of the Note and Deed of Trust has occurred and proper notification of the parties and proper notification of said default has previously occurred; and
WHEREAS, HAZEL DEVELOPMENT, LLC, the owner and holder of said Note and Deed of Trust, has demanded the real property described in the Deed of Trust be advertised and sold in satisfaction of said debt. The real property as described in the Deed of Trust will be advertised and sold in satisfaction of said debt and any costs legally accruing in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that I, STEFFANIE M. SPECK, ESQ., as Trustee, or my agent, pursuant to the power, duty and authority vested in and imposed upon me in said Deed of Trust, will on February 4, 2025, at 11:00 A.M., prevailing time, at the main entrance of the Knox County Courthouse, Knoxville, Tennessee, where foreclosures are customarily conducted, will offer for sale to the highest and best bidder for cash and in bar of the right and equity redemption, whether statutory or common law, the right of redemption granted by Tennessee Code Annotated Section 66-8-101 (as amended or renumbered), homestead, dower, marital share, and all other rights and exemptions of every kind, all of which have been expressly waived by grantors as provided in said Deed of Trust, certain real property more particularly described as follows:

BEING the same property conveyed to Brandon Lee Gibson and wife, Jocelyn Gibson, under Warranty Deed dated November 30, 2015, and recorded as Instrument Number 201512010033341 in the Register’s Office for Knox County, Tennessee.

In the event of a discrepancy between the property address and the property description, the property description shall control. The right is reserved to adjourn the day of sale to another day and time certain, without further publication and in accordance with the law, upon announcement of said adjournment on the day and time and place of sale set forth above.
No warranties are made as to the merchantability of title of said real property, which property is being sold, “where is, as is”, subject to all restrictions, easements, governmental zoning or regulations, subdivision ordinances or regulations in effect with respect to the property, unpaid property taxes, assessments and all superior encumbrances and liens, if any, whether of record or not. The Trustee herein makes no representations or warranties as to status of title or description of this property.
Should the highest bidder fail to comply with the terms of the bid at the public sale, then the Trustee shall have the option of accepting the second highest bid, or the next highest bid with which the buyer is able to comply.
The Trustee will make a deed to the purchaser on the day of sale, and the premises will be sold subject to any unpaid taxes, other than those tax encumbrances which are divested by nonjudicial sale, further, the premises will be sold subject to any and all other restrictions, encumbrances and any governmental zoning or regulations and subdivision ordinances or regulations in effect with respect to the property.
The sale held pursuant to this Notice may be rescinded at the Trustee’s option at any time.
